Your Legal Obligations — Commercial and Residential Property
Duty to Manage Asbestos
Under the Control of Asbestos Regulations 2012, any person with responsibility for the maintenance of a non-domestic building has a legal duty to manage asbestos risk. This includes commercial landlords, freeholders, facilities managers and employers who occupy their own premises. An asbestos management survey and register must be in place, with annual re-inspections to keep it current.
Pre-Works Demolition Surveys
A Refurbishment and Demolition Asbestos Survey is a legal requirement before any refurbishment or demolition work begins. This applies to all pre-2000 commercial and residential buildings where the building fabric will be disturbed. Works cannot legally start until the survey is complete. HSE enforcement of this requirement is active and ongoing.
Fire Risk Assessments
Under the Regulatory Reform (Fire Safety) Order 2005, the Responsible Person for any commercial premises must ensure a written fire risk assessment is in place and kept up to date.
